Shooting victim in 'stable, but critical' condition

PALESTINE —

A local woman remains in stable, but critical condition at a Tyler hospital Monday after being shot four times by her estranged ex-husband during an altercation Friday morning at a north Palestine trailer park.

The man, identified as Octoavio Guerrero Garcia, 32, was shot and killed by the female victim Nicole Lynn Guerrero, 32, during a dispute that occurred just prior to 11:24 a.m. on Friday at a mobile home park, located in the 100 block of ACR 362 just off Texas 155.

“It appears that Garcia, 32, went to his estranged ex-wife's residence with a (small caliber) gun, forced his way in and fired shots at her, striking her multiple times,” Taylor said Friday. “A physical struggle then occurred between the two, during which the woman was able to take the gun away from Garcia and shoot him multiple times in return.

“The woman then fled her residence in her ex's truck and went to the home of a neighbor, located about 200 yards away and collapsed on the porch,” he added. “She was life-flighted to Tyler for gunshot wounds and was stable at that time.”

According to Taylor, Guerrero was shot four times — once in the arm and three times in the torso — by Garcia, who was shot two times in the torso by Guerrero, according to autopsy reports.

Garcia was transported to Palestine Regional Medical Center, where he was later pronounced dead by Precinct 2 Justice of the Peace Carl Davis.

According to the sheriff, the female victim was “conscious and coherent” enough at the scene to give a clear report about what had occurred.

“She has undergone some surgeries and may be undergoing more,” Taylor said about Guerrero's condition on Monday. “According to our investigators, her doctors are reporting that she will likely recover, but it will be a long process.”
